Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Christian Pons, a micro-entrepreneur (SIREN: 109 036 210), operating the online store H2O RESPIRO on h2orespiro.com, and any customer making a purchase on this site.

Article 1 – Seller Identification

Article 2 – Products

The products offered for sale are fashion items and accessories (t-shirts, hoodies, caps, bob hats) from the Dragon Flow collection, available on h2orespiro.com. Product photographs and descriptions are as accurate as possible but are not contractual.

Article 3 – Prices

Prices are indicated in euros (EUR), all taxes included. VAT not applicable in accordance with Article 293 B of the CGI. H2O RESPIRO reserves the right to modify its prices at any time, it being understood that the price applicable to the order is that in force at the time of order validation.

Article 4 – Order

The customer places an order online via the h2orespiro.com website. The order is validated after payment confirmation. A confirmation email is sent to the customer.

Article 5 – Payment

Payment is made online using the methods offered during the order (credit card, etc.). Payment is secured via the Shopify Payments platform.

Article 6 – Delivery

Products are made to order via a print-on-demand service provider. Delivery times are indicated during the order and may vary depending on the destination. H2O RESPIRO cannot be held responsible for delays attributable to the carrier.

Article 7 – Right of Withdrawal

In accordance with Article L221-18 of the Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to provide reasons. Personalized or custom-made products are excluded from the right of withdrawal in accordance with Article L221-28 of the Consumer Code.

Article 8 – Returns and Refunds

In case of a defective or non-conforming product, the customer must contact H2O RESPIRO at chrisponschris@gmail.com within 14 days of receipt. A replacement or refund will be offered depending on the case.

Article 9 – Liability

H2O RESPIRO cannot be held responsible for indirect damages related to the use of products purchased on the site.

Article 10 – Applicable Law

These GTC are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the competent courts will be those of the seller's domicile.
