ARTICLE 1 – SCOPE OF APPLICATION
These General Terms and Conditions of Sale (“GTC”) apply to all sales made on h2orespiro.com between H2O RESPIRO, operated by Christian Pons, sole proprietor (Entrepreneur individuel), SIREN 109 036 210, whose business address is 256 route du Châtelard, 73370 Le Bourget-du-Lac, France, and any consumer (the “Customer”).
ARTICLE 2 – PRODUCTS
The products offered for sale are physical goods described on the website. H2O RESPIRO reserves the right to modify its product range at any time.
ARTICLE 3 – PRICES
Prices are stated in euros (€). VAT is not applicable pursuant to Article 293 B of the French General Tax Code (Code général des impôts). H2O RESPIRO reserves the right to change its prices at any time. Products are invoiced at the price in force when the order is confirmed.
ARTICLE 4 – ORDERS
The Customer places orders online through h2orespiro.com. An order is confirmed by the sending of a confirmation email. H2O RESPIRO reserves the right to cancel an order in the event of a stock or payment issue.
ARTICLE 5 – PAYMENT
Payment is made online using the payment methods offered on the website. The order is validated once payment has been confirmed.
ARTICLE 6 – DELIVERY
Products are delivered to the address provided by the Customer when ordering. Preparation and delivery times shown on the website or at checkout are estimates and may vary depending on the product, destination and carrier. In the event of a delay or delivery issue, the Customer may contact H2O RESPIRO at contact@h2orespiro.com so that the situation can be reviewed. The Customer’s statutory rights remain unaffected.
ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with Article L221-18 of the French Consumer Code, the Customer has 14 days from receipt of the product to exercise the right of withdrawal without having to give any reason. Return shipping costs are borne by the Customer unless otherwise agreed or provided by law.
The statutory exception applies in particular to goods made to the consumer’s specifications or clearly personalized. A standard product manufactured on demand is not automatically considered personalized.
ARTICLE 8 – RETURNS AND REFUNDS
When the Customer exercises the right of withdrawal, H2O RESPIRO refunds all sums paid, including delivery charges corresponding to the standard delivery method offered, without undue delay and no later than 14 days from the date on which H2O RESPIRO is informed of the Customer’s decision to withdraw.
H2O RESPIRO may withhold the refund until the product has been recovered or until the Customer provides proof of shipment, whichever occurs first.
The refund is made using the same means of payment as that used for the order, unless the Customer expressly agrees to another means of payment that does not result in any fees.
ARTICLE 9 – STATUTORY WARRANTIES
H2O RESPIRO is liable for the statutory warranties applicable to products sold to consumers.

Statutory warranty of conformity
The consumer benefits from the statutory warranty of conformity provided for by Articles L. 217-3 to L. 217-20 of the French Consumer Code. This warranty may be invoked for two years from delivery of the product. Subject to the conditions laid down by law, the consumer may request repair or replacement free of charge. Where conformity cannot be restored, is refused, is delayed, or in the other cases provided by law, the consumer may obtain a price reduction or termination of the sale.
Warranty against hidden defects
The consumer also benefits from the warranty against hidden defects provided for by Articles 1641 to 1649 of the French Civil Code. Proceedings must be brought within two years of discovery of the defect. Subject to the legal conditions, the consumer may keep the product and obtain a reduction in price, or return the product and obtain a refund of the purchase price.
These statutory warranties apply independently of any commercial warranty.
The consumer has two years from delivery of the goods to obtain implementation of the statutory warranty of conformity in the event of a lack of conformity. During this period, the consumer only needs to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service for a period exceeding two years, the statutory warranty applies to that digital content or digital service throughout the agreed supply period. During this period, the consumer only needs to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The statutory warranty of conformity requires the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The statutory warranty of conformity gives the consumer the right to repair or replacement within 30 days of the request, free of charge and without major inconvenience. If the goods are repaired under the statutory warranty of conformity, the consumer benefits from a six-month extension of the original warranty. If the consumer requests repair but the seller imposes replacement, the statutory warranty of conformity is renewed for two years from the date of replacement.
The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, in the cases provided by law, including where the professional refuses repair or replacement, where repair or replacement takes more than 30 days, where it causes major inconvenience, or where the lack of conformity persists despite an unsuccessful attempt to restore conformity.
The consumer also has the right to an immediate price reduction or termination of the contract where the lack of conformity is sufficiently serious. Termination is not available where the lack of conformity is minor.
Any period during which the goods are unavailable because they are being repaired or replaced suspends the remaining warranty period until the repaired or replacement goods are delivered.
The rights referred to above result from Articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who, in bad faith, obstructs implementation of the statutory warranty of conformity may incur the civil fine provided for by Article L. 241-5 of the French Consumer Code.
The consumer also benefits from the statutory warranty against hidden defects under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. This warranty entitles the consumer to a price reduction if the goods are kept, or a full refund in exchange for returning the goods.

Personal data collected is processed in accordance with the Privacy Policy available on the website.
